What are the benefit limits from which specified accommodation is exempt?
Basic info
Category 1 exempt accommodation enjoys the following protections:
- The Local Housing Allowance does not apply
- The Local Reference Rent does not apply
- The restriction on the amount of HB under 35s receive does not apply
- The Maximum Rent (i.e the bedroom tax) does not apply
- The Housing Benefit does not count towards the benefit cap
- The eligible rent cannot be restricted unless it is unreasonably high in comparison to suitable alternative accommodation elsewhere
- The rent payable for exempt accommodation is covered by HB instead of a Universal Credit housing element
Categories 2, 3 and 4 specified accommodation enjoy the following protection only:
- The Housing Benefit does not count towards the benefit cap
- The rent payable for specified accommodation is covered by HB instead of a Universal Credit housing element
